Handling Personal Injury Cases – in and out of Court

At the Chernoff Law Firm, we are not just litigators – we are problem solvers.

If you’ve been injured…

If you have been injured in an accident, or due to medical malpractice, you may be dealing with:

  • pain
  • suffering
  • disability
  • the inability to work
  • the inability to enjoy the pleasures of life, including sports and marital relations
  • medical bills
  • rehabilitation expenses
  • medical equipment expenses
  • stress and anxiety

Fortunately for accident victims, insurance is available to compensate for many injuries. The problem is, insurance companies may stonewall victims or make lowball offers in hopes of getting rid of them cheaply. Even when presented with evidence of the severity of an injury and ongoing expenses, they may refuse to negotiate a better deal.

Sometimes, insurance companies even engage in what is known as “bad faith” conduct toward insured parties.

Often, it takes the threat of litigation to bring an insurance company to the negotiating table.

You might be ready to hire a litigator because you are unable to make progress with an insurer, or want to be sure you are dealt with fairly. Maybe you are in one of these situations:

  • You’ve been injured, and the insurance company refuses to make you a reasonable settlement offer
  • You’ve been the victim of legal or medical malpractice
  • You’re one of thousands of people who suffered some common harm

If you’re being sued…

You might be looking for a litigator because you have been served (or threatened) with a lawsuit.

You might be a medical professional facing a malpractice claim.

You might be fighting with the insurance company that is supposed to cover your legal bills when you get sued – but refuses to.

We Focus on Civil Disputes

Whether you’re a plaintiff or a defendant in a personal injury case, the Chernoff Law Firm can help.

Unlike some law firms, we are not “one size fits all.” We do not handle divorces, wills, or criminal cases.  We do not handle adoptions, immigration, or other cases outside our main practice areas.

We focus on civil litigation – including personal injury cases and medical malpractice.

Settlements that Make Sense

Only about 2% of personal injury cases ever go to trial. Some of them get dismissed before trial. Most of them settle.

We help structure settlements so that they meet our clients’ specific needs.

For example, one of our clients was a toddler who suffered injuries causing facial scars. The amount of compensation was not in dispute. However, the child’s parent was concerned about the downside of the child receiving a large pot of money upon turning 18 — especially since there was a family history of substance abuse.

We arranged for a structured settlement. The settlement funds were used to buy an annuity. This provided for small payments each year when the child would typically be in college, to cover tuition. Additional payments would come later – when the child was older and more mature. The largest sum came last – when the child could use it to buy a house or start a business.
